I’M RENTING A HOUSE THAT’S ON THE MARKET FOR SALE. THERE IS A MAINTENANCE AND REPAIR CLAUSE WHICH STATES:
“LESSEE WILL, AT LESSEE’S SOLE EXPENSE, KEEP AND MAINTAIN THE LEASED PREMISES AND APPURTENANCES IN GOOD AND SANITARY CONDITION AND REPAIR DURING THE TERM OF THIS LEASE AND ANY RENEWARL THEREOF… MAJOR MAINTENANCE AND REPAIR OF THE LEASED PREMISES, NOT DUE TO LESSEE’S MISUSE, WASTE OR NEGLECT, SHALL BE THE RESPONSIBILITY OF WHO THE LESSOR OR LESSEE ASSIGNS.”
THE LANDSCAPE CONTRACTOR OF THE HOA CUTS THE LAWN, BUT DOESN’T TEND TO ANY WEEDS, WHICH ARE A PROBLEM– THERE ARE WEEDS EVERYWHERE. I’VE BOUGHT LARGE BOTTLES OF WEED KILLER & SPRAYED, BUT THE WEEDS DON’T APPEAR TO BE GOING ANYWHERE.
I REALIZE I’M THE LESSEE, BUT THIS IS MY SECOND YEAR OF DEALING WITH THIS. I DID IT LAST YEAR, BUT THE WEED PROBLEM CLEARLY EXISTED BEFORE I MOVED IN– AS SOON AS SPRING ROLLED AROUND, WEEDS WERE EVERYWHERE!! IT’S A MAJOR PROBLEM AND AT THIS POINT SEEMS LIKE IT SHOULD BE THE LANDLORD’S.

The landlord has a general obligation to keep the primise in “good condtiion”. You assume that “good condition” implies weed free. It appears, he does not. What did your landlord tell you when you asked him about this?

For the same as landlord all my renters are responsible to keep it up its the first 50 of repair unless they caused it is your responsiblity whats the big deal 20 for the first 50 of repair unless they caused it up.
